Terms and Conditions

By using our website www.doabotanicals.com and placing an order, the user agrees to the following
Terms and Conditions and Usage Terms. These conditions apply to all offers and agreements made
by DOA Botanicals B.V. (hereinafter referred to as “DOA Botanicals”), which supplies products
and/or services via the website. Please read them carefully to fully understand what you can expect
from us and what obligations you have.

Article 1: Definitions

In these terms, the following terms are defined as follows:

1. DOA Botanicals: A company incorporated under Dutch law, based in Rotterdam, registered
   with the Chamber of Commerce under number 95310363.

3. User/Consumer: A natural person who visits the Website or uses the services, products, or

   services, falling under these Terms and Conditions.

Article 2: Applicability

These Terms and Conditions apply to all use of the Website and to all agreements made via the
Website between DOA Botanicals and the Consumer. By using the Website or placing an order,
the Consumer fully accepts these terms. The Terms and Conditions may be modified from time
to time; the most recent version will always be posted on the Website.

Article 3: Prices and Payment

1. Prices: All prices on the website include VAT and any other government-imposed taxes,
   unless stated otherwise. DOA Botanicals reserves the right to change the prices without prior
   notice.
2. Payment Methods: Payment can be made using the payment methods offered on the
   website. DOA Botanicals reserves the right to change the available payment methods. All
   payments are secure and encrypted.
3. Shipping Costs: Shipping costs will be clearly indicated during the checkout process. These
   costs are the responsibility of the Consumer, unless otherwise stated.

Article 4: Orders and Formation of the Agreement

1. The Agreement is formed when the Consumer accepts DOA Botanicals’ offer by placing the
   order and making payment.
2. Upon electronic acceptance, the Consumer will immediately receive a confirmation of
   receipt of the order. The Consumer has the right to cancel the agreement until this
   confirmation is received.
3. DOA Botanicals may refuse an order or impose additional conditions if there are doubts
   about the Consumer’s ability to pay.
4. The product descriptions on the Website are not binding offers from DOA Botanicals, but
   are intended to invite the Consumer to make an offer.
5. The Consumer makes an offer by adding the desired products to the shopping cart and
   completing the ordering process.
6. All prices on the Website include VAT and other taxes, unless stated otherwise. Prices may
   change without prior notice.
7. The product information on the Website is carefully compiled. However, there may be
   inaccuracies or incompleteness in the product information. DOA Botanicals does not
   guarantee the accuracy or completeness of this information and is not liable for any errors.

Article 5: Delivery

1. DOA Botanicals will deliver the products as soon as possible after receiving the order,
   according to the indicated delivery time on the website. The average delivery time is 3-5
   business days, unless otherwise stated. If a product is temporarily unavailable, DOA
   Botanicals reserves the right to delay delivery.
2. Loss or Damage During Delivery: DOA Botanicals is not liable for damage occurring
   during delivery, unless the company itself is responsible for the delay or damage.
3. If the delivery takes longer than expected, the Consumer will be notified.

Article 6: Right of Withdrawal and Returns

1. The Consumer has the right to withdraw from the agreement within 14 days of receiving the
   products without giving a reason.
2. Products must be returned unused, undamaged, unopened, and in their original packaging.
3. Return Costs: The costs of returning products are the responsibility of the Consumer,
   unless the product is defective or does not conform to the agreement.
4. Loss or Damage During Return: The Consumer is responsible for the safe return of the
   product. DOA Botanicals recommends using a track & trace code when returning products.
   DOA Botanicals is not responsible for loss or damage during the return process.
5. Refund: DOA Botanicals will refund the purchase amount within 5-10 days after receiving
   the returned product, unless otherwise agreed.
6. The Consumer must notify DOA Botanicals of the right of withdrawal within 14 days via

Article 7: Warranty and Conformity

1. DOA Botanicals guarantees that the delivered products meet the agreement, the stated
   specifications, and the reasonable requirements for quality and usability.
2. In case of justified complaints, DOA Botanicals will repair, replace, or refund the product,
   with a maximum equal to the price paid for the product.
3. Satisfaction Guarantee: If the Consumer is not satisfied with the results of a product, it can
   be returned within 30 days of receipt for a full refund (if unopened). For exact information,

Article 8: Complaints Procedure

1. Complaints regarding a product or the services of DOA Botanicals can be submitted via
   email.
2. DOA Botanicals will respond within 5 business days after receiving the complaint. If more
   time is required for a substantive solution, a timeline for resolution will be provided.

Article 9: Personal Data

1. DOA Botanicals processes the Consumer’s personal data in accordance with the privacy
   policy published on the website. The data is used solely for processing orders and improving
   our services.
2. We only collect the necessary data to process orders and enhance our customer service. If
   you sign up for our newsletter, your email address may be used for marketing purposes. You
   can unsubscribe at any time.

Article 10: Liability

1. DOA Botanicals is not liable for damage caused by incorrect, incomplete, or untimely
   information provided on the website.
2. DOA Botanicals’ liability for damage resulting from defective products is limited to the
   repair, replacement, or refund of the product, as described in the warranty and conformity
   provisions.

   disasters, war, strikes, epidemics, pandemics, government measures, disruptions in the
   supply of raw materials or transport, or other unforeseen circumstances beyond DOA
   Botanicals’ control.

Article 13: Final Provisions

1. Dutch law applies to the Agreement.
2. The competent court in the Netherlands will have exclusive jurisdiction over any disputes
   arising from the Agreement.
3. If any provision of these Terms and Conditions is found to be invalid, the validity of the
   remaining provisions will remain unaffected.
